We’re updating our Privacy Policy to make it clearer around the types of personal information we may collect about you when you interact with us. It also explains how we’ll store and handle that information and keep it safe.

Below you’ll find some FAQs along with the updated Privacy Policy which will come into effect on Saturday 12 November 2022.

This privacy policy ("Policy") sets out how we collect, use, store and disclose your personal information when you interact with us (like when you join or use any of our programmes, use any of our website or mobile apps or deal with any of our team members).

If you give us information about anyone else, then that person must have agreed to you giving us their information. There may be times when we need to change this Policy. When we do so, we'll tell you about any changes. This may be by posting an updated policy on our website or sending you an email. This Policy is subject to and should be read in conjunction with any other terms and conditions you agree to when using or signing up to any of our services or promotions.

  • name, contact details (such as your email and phone number), delivery address and payment information;
  • phone conversations with our staff, which may be recorded;
  • email communications, your communications with us over social media and your written and verbal interactions with us;
  • details of the products or services you have purchased from us;
  • your interests and preferences in our products and services, such as survey and recipe rating data;
  • account, payment and credit information;
  • any details you give us when you sign up to one of our promotions, loyalty programs or competitions;
  • details of your household (such as the number of members), if you provide this information to us;
  • details about your IP address, computer, mobile device, operating system and other usage information if you visit us via website or app; and;
  • any other information you provide to us.

What happens when you visit our website or app?

When you visit or use our website or app, we collect information, including the IP address of your machine or device), the operating system and the browser your machine or device uses, the date and time you are visiting and the pages you view.

Our website may also collect information through the use of "cookies" in order to provide better customer service.   • Register for and use our subscription based service, or join a promotion or programme.
  • Visit one of our websites or use one of our apps.
  • Participate in a survey, promotion or competition.
  • Communicate with us, including online (e.g through our social media channels) and with our Customer Love team.

We may collect personal information from other sources, if it’s relevant to a particular promotion, programme or service, such as Meta competitions.

We are careful about collecting your information from other sources and ensure we comply with the Privacy Act 2020.

How do we use your information?

We may use your personal information:

  • so that we can provide you with our products, services, information (including delivery updates and customer support) and to respond to you when you get in touch with us;to ensure your eligibility for our services (including assessing your credit-worthiness);
  • to comply with our obligations to you and other third parties involved in the supply of our products to your property;
  • to improve or update our services, products and our website/app and help you access new ways to use our services;
  • for internal purposes like processing transactions, administering your account, staff training and billing;
  • to let you know about product, services and specials that might be of interest to you from us and trusted partners. We might do this via different channels including emailing, phone, SMS and via app;

This helps us improve My Food Bags products and services and offer you a more personalised service, including sending you information about goods and services that are likely to be of most interest to you, and to show you advertising and information that is most relevant to you and your interests;
  • to make sure our offerings stay relevant and of interest to you. For example, we may contact you to request that you take part in market research and surveys, and if you contact our Customer Love team, we may record your call for quality and training purposes;
  • so we can administer prize competitions. Please be aware that, in some cases, you may be automatically entered into a competition by purchasing an eligible product over a specified number of weeks; My Food Bag would send you an email to advise of this; and
  • for the purposes of any sale, transfer or assignment of any part of our business or our entire business.

By providing your email address or mobile phone number, you consent to us sending you information connected with the above purposes via email or text message.

If you use our app, then you consent to receiving notifications from us even when the app is not running. You can opt out of notifications from the app by configuring your preferences in the app's settings or your mobile's settings.

Please note that starting a new subscription or making a new purchase from us will reset your email communication preferences.

How can I opt out of direct marketing preferences?

You can opt out of receiving marketing and promotional messages at any time, by doing one of the following:

  • clicking the unsubscribe button in an email to stop promotional emails or change communication preferences;
  • responding to any text/SMS STOP to stop promotional text messages;
  • calling our Customer Love team, emailing them at [email protected] or contacting us via Webchat from our website to stop all marketing ; and opt out of app promotional notifications by configuring your preferences in the app's settings or your mobile's settings.

How can you access or correct your personal information?

You can ask to access your personal information, or correct it, at any time by contacting us using the details below. Before we provide you with access to your information, we may require some proof of identity. Please see details at the end of this Policy.

You can also update your personal information, and change your preferences, on our website www.myfoodbag.co.nz by signing into your account.

Who do we disclose your information to?

We understand that your personal information belongs to you, and that you trust us to keep it safe and secure. We’re committed to protecting your personal information. Sometimes, we will share your personal information for the purposes set out in this privacy policy. That includes:

  • where you have authorised us to do so;
  • to service providers who help us provide our products and services to you. For example:
  • logistics and delivery providers who help us deliver your order;
  • advertising, social media and search engine companies, such as Meta and Google, where we pay for advertisements to be shown. We provide them with a limited amount of your information, to help them target this advertising for you on their platforms;
  • advertising, analytics and research partners who help us understand insights about you and provide more tailored services;
  • credit checking or debt collection agencies;
  • to competition partners that we collaborate with on competitions including so you can receive prizes;
  • to third parties for the purposes of any sale, transfer or assignment of any part of our business or our entire business;
  • to decision makers who help to resolve a complaint you make about us; and
  • to meet our legal obligations or where we are entitled, required or permitted to under the Privacy Act or any other law. For example, where disclosure is to a law enforcement agency that is entitled to such information under its statutory powers.

Other things you should know

Your personal information is collected and stored by us. We will take reasonable steps to protect personal information that is held by us from unauthorised access, use, disclosure, alteration, or destruction. When your personal information is held by us, it can only be accessed by our authorised staff or representatives when required for the purposes set out in this Policy. Access is subject to strict log in requirements, and we have systems in place to prevent unauthorised access.

Some of our data is stored outside of New Zealand. When we store or send data overseas, we will ensure that adequate systems are in place to protect your information as required under the Privacy Act.

Please note that we do not hold full credit or debit card details as this service is operated by Windcave and covered by its privacy policy.

We will hold your information for as long as it is required for the purposes outlined above.

Under the Privacy Act, you have the right to request to obtain, or have corrected, any personal information we hold about you where that information may be readily accessed and retrieved.
